Esse India Refund Policy

1. Introduction and Agreement Overview

This document outlines the terms and conditions agreed upon between the client (hereafter referred to as “the Client”) and ESSE INDIA Immigration & Visa Consultants (hereafter referred to as “ESSE INDIA”). By engaging with our services, the Client acknowledges that they have read, understood, and agreed to the provisions mentioned herein. This agreement governs the consultancy services provided by ESSE INDIA in relation to immigration, study abroad, or visa application processes for various countries.


2. Invoice Structure and Refund Basis

The total invoice amount presented to the Client encompasses the entire cost associated with services rendered, which may include both consultancy fees and any third-party costs incurred during the application process. However, it is expressly stated that any applicable refund will be restricted solely to the consultancy fee charged by ESSE INDIA. No portion of fees paid towards third-party services will be considered refundable under any circumstances.


3. Eligibility Criteria for Refund

A refund may only be considered in cases where the visa, immigration, or application is officially rejected by the concerned authority or body, and where such rejection is not attributed to the Client’s non-compliance, delay, or submission of fraudulent or incorrect information.

In order to initiate a refund process, the Client must adhere to the following procedure:

  • Submit a duly completed Refund Request Form

  • Attach a copy of the official rejection letter or refusal stamp

  • Provide a copy of the original payment receipt

  • Ensure submission of all documents within the stipulated period post-rejection

Once the complete and valid documentation is submitted, the refund, if approved, will be processed within 60 working days. Refunds will be issued only to the original payer through the original mode of payment unless otherwise mutually agreed in writing.


4. Non-Refundable Components and Third-Party Charges

It is clearly understood and accepted by the Client that the following costs are non-refundable under any circumstances:

  • Government or embassy application fees

  • Third-party evaluation or assessment body charges

  • IELTS, PTE, French, or other language test fees

  • Courier, translation, or notarization charges

  • Medical examination and police clearance costs

  • Any expenses not directly paid to ESSE INDIA

The Client acknowledges that these costs are paid to third parties and ESSE INDIA neither controls nor recovers these fees.


5. Payment Terms and Dispute Resolution

Clients making payments via online gateways (including credit/debit cards, net banking, or UPI) agree not to dispute or raise a chargeback without first contacting ESSE INDIA to resolve the matter amicably. Any unauthorized chargeback or transaction reversal will be considered a breach of this agreement and may lead to legal proceedings to recover the full dues along with additional administrative or legal fees.


6. Fee Justification and Market Comparison

The consultancy fee charged by ESSE INDIA is determined based on the quality of services, the expertise of consultants, and the time-intensive nature of immigration assistance. The Client agrees that comparisons with competitor fees or discounts offered elsewhere do not constitute valid grounds for refunds or renegotiation of fees after registration.


7. Client Responsibilities and Obligations

To ensure a smooth and successful process, the Client agrees to:

  • Submit all required documents accurately and within 30 days of signing this agreement

  • Attend all scheduled interviews and appointments as directed

  • Ensure documents such as police clearance certificates and medical reports are valid and authentic

  • Maintain active and timely communication with their assigned consultant

Any breach of these responsibilities, whether through delay, inaccuracy, or failure to cooperate, will result in disqualification from any refund eligibility.


8. Language Test and Documentation Requirements

If language proficiency is required (IELTS, PTE, French, etc.), the Client and their dependents are expected to achieve the minimum score recommended by ESSE INDIA for eligibility.
Failure to meet these requirements by any family member included in the application will result in cancellation of the process without refund.


9. Situations Where No Refund Will Be Provided

The Client shall not be eligible for a refund under the following circumstances:

  • Visa rejection due to submission of fraudulent or misleading information

  • Failure to attend embassy or consulate interviews

  • Non-compliance with procedural requirements or timelines

  • Changes in personal plans or decisions, including withdrawing from the process

  • Rejection due to changes in immigration law or policy after signing the agreement

  • Abandoning the process or remaining inactive for 90 days or more

  • Requesting a shift in country, program, or purpose of migration post-registration


10. Cap-Limited Applications and Government Quotas

In countries that operate on a quota or cap-based system for immigration, ESSE INDIA shall not be held responsible for any delay or rejection that results due to quota exhaustion. The Client understands that cap-based applications are beyond the control of any consultant or agency.


11. Confidentiality of Client Information

ESSE INDIA values client confidentiality and complies with data protection and privacy regulations. All client information shared with ESSE INDIA will be used strictly for official purposes and will not be disclosed to third parties without the Client’s consent unless required by law.


12. Legal Jurisdiction and Governing Law

All disputes arising from this agreement or the services provided by ESSE INDIA shall be governed by and interpreted in accordance with the laws of the Republic of India. The courts in New Delhi shall have exclusive jurisdiction over any such disputes.


13. Final Declaration and Agreement

By proceeding with payment or registration with ESSE INDIA, the Client confirms:

  • They have read, understood, and accepted all terms stated in this document

  • They are engaging with ESSE INDIA services willingly and voluntarily

  • They agree to be bound by all clauses, obligations, and limitations set forth in this agreement
